These Terms and Conditions (“Terms”) govern your use of the 3Smarter web application (“Service”), which is a trading name of Test-n-Tell Ltd, a company registered in England under company number 14272094, with its registered address at 85 Great Portland Street, First Floor, London, England, W1W 7LT (“Company,” “we,” “us,” or “our”).

All payments, invoices, and receipts will be issued under the legal entity Test-n-Tell Ltd, which will appear as the merchant name in billing records.

By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

  1. 1. Service Overview

    3Smarter is provided as a Software-as-a-Service (SaaS) platform, available as a free tier and a premium tier on a subscription basis. The Service is provided “as is” without guarantees of uninterrupted availability or error-free operation.

  2. 2. Accounts

    To use the Service, you must provide a valid email address.

    You are responsible for maintaining the confidentiality of your account and for all activity under your account.

    You agree not to use the Service for unlawful or unauthorized purposes.

  3. 3. Subscriptions and Payments

    Premium access to the Service requires a paid subscription.

    Subscriptions are billed on a monthly basis.

    You may cancel your subscription at any time, effective at the end of the current billing period.

    Billing & Invoices: Payments are processed by Paddle, our Merchant of Record. Invoices and receipts will show Test-n-Tell Ltd as the legal entity.

  4. 4. Refund Policy

    Payments are generally non-refundable.

    Refund requests are handled in accordance with Paddle’s Consumer Terms (available at: https://www.paddle.com/legal/invoiced-consumer-terms). Refunds are provided at the sole discretion of Paddle and on a case-by-case basis and may be refused. Paddle will refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour that entitles Paddle to counterclaim the refund. This does not affect your rights as a Consumer in relation to Products which are not as described, faulty or not fit for purpose.

    If you are a Consumer and unless the below exception applies, you have the right to cancel this Agreement and stop using the Premium product plan within 14 days without giving any reason. The cancellation period will expire after 14 days from the day after completion of the Transaction. To meet the cancellation deadline, it is sufficient that you send Paddle your communication concerning your exercise of the cancellation right before the expiration of the 14 day period. To cancel your order, you must inform Paddle of your decision. To ensure immediate processing, please do so by contacting Paddle at https://paddle.net/. Please note that in respect of subscription services your right to cancel is only present following the initial subscription and not upon each automatic renewal.

  5. 5. Free Tier

    We may offer a free tier of the Service. We reserve the right to modify or discontinue the free tier at any time, without notice.

  6. 6. AI-Generated Content Disclaimer

    Parts of the Service use artificial intelligence (AI) to generate content (such as practice material, exercises, or text).

    We apply reasonable measures to filter and prevent the generation of explicit or offensive content, but we cannot guarantee that all AI outputs will be appropriate, accurate, or error-free.

    By using the Service, you acknowledge that AI-generated content may occasionally be inaccurate, incomplete, or unsuitable, and you agree that reliance on such content is at your own risk.

    Test-n-Tell Ltd disclaims liability for any damages or issues arising from AI-generated material.

  7. 7. Intellectual Property

    All intellectual property rights in the Service, including software, design, and content, are owned by or licensed to Test-n-Tell Ltd. You may not copy, modify, or distribute any part of the Service without our written consent.

  8. 8. Limitation of Liability

    The Service is provided “as is” and “as available.”

    To the maximum extent permitted by law, Test-n-Tell Ltd disclaims all warranties, express or implied.

    We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

    Our total liability to you will not exceed the amount paid by you in the 1 month prior to the claim (or £0 if you use the free tier).

  9. 9. Termination

    We may suspend or terminate your account if you breach these Terms or misuse the Service. You may stop using the Service at any time by cancelling your subscription and/or deleting your account.

  10. 10. Changes to the Terms

    We may update these Terms from time to time. The latest version will always be available on the website, and continued use of the Service constitutes acceptance of the updated Terms.

  11. 11. Governing Law

    These Terms are governed by the laws of England and Wales, and disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These translations are provided for convenience only. In case of conflict or inconsistency, the English version shall prevail.
